After a week of controversy a French high court has ruled that the proposed burkini ban in French resort towns is illegal.

The State Council today upheld a challenge to the ban by human rights groups which argued that the restriction on burkinis in the Riviera infringed on personal freedoms. The judged that the ban “constituted a serious and manifestly illegal infringement of fundamental liberties”.

According to Patrice Spinosi, a lawyer for the Human Rights League, the State Council’s decision to suspend the law will apply to 29 French towns which have banned the burkini.

The ruling comes after controversy when earlier this week photos of armed police forcing a Muslim woman to remove clothes on the beach were circulated online. Many were appalled by the infringement on personal liberty the photo represented.

Since it was implemented in France 24 women have been fined in Nice, and another six in Cannes. The 30 women were forced to pay €38 each.

Sales of the burkini also went up 200 per cent. So it obviously didn’t work that well.
